1. The injury must have been caused by the treatment
You must have suffered an injury caused by treatment, examination, diagnosis or follow-up provided. An injury may be temporary or permanent. If the injury was caused by the ailment for which you received treatment, you are not entitled to compensation.
2. The injury must have been caused by failings in the treatment provided
For you to be entitled to compensation, your injury must have been caused by failure in the treatment you have received. If the injury sustained is not related to an error or omission in the treatment, you will not normally be entitled to compensation.
In some exceptional cases, compensation will be awarded even though no error in the treatment has occured. This happens if the injury is of a particularly significant or unexpected nature.
3. The injury must have caused financial loss
The injury must have caused financial loss. The intention is for the compensation to cover the increased costs incurred for medical treatment, medication, transport etc. You may also be entitled to compensation for loss of earnings or loss of provider.
If your financial loss is less than NOK 5,000, you will not be eligible for compensation from NPE. Instead, you should contact the institution where you received the treatment.
If you have had a bad experience or suffered temporary pain, but no financial loss, you are not entitled to compensation. A compensation award can never be granted as a means of redress.
In some cases, you may be eligible for compensation even if you have not incurred a financial loss, e.g. if you have sustained a permanent and significant injury. This is referred to as "permanent injury compensation". Permanent injury compensation is intended to compensate for a reduced quality of life.
4. The injury must not be too old (overdue claims)
You may apply for patient injury compensation no later than three years after you ought to have understood that your treatment, or the lack of treatment, is the cause of your injury. For further information, see foreldelse.
