How to write a statement

It is important that the healthcare provider assesses the treatment that was given. Below you will find guidance on how to write a statement as the healthcare provider concerned in the case.

In some cases, we may be able to resolve the case based solely on the healthcare provider’s assessment. This statement may also be the only opportunity for the healthcare provider to comment on the compensation claim. A summary of the patient’s medical history is not required in the statement.

How to write the statement

We ask that you submit the statement electronically. The form contains six sections that must be completed:

  1. Describe what the patient was examined or treated for, and which examinations or treatments were provided. Please state the relevant diagnostic and treatment codes.

  2. Has the patient suffered an injury or complication as a result of the examination or treatment that is the subject of the complaint?

  3. Provide a professional assessment of the treatment the patient received. Was it in accordance with good medical practice? Please assess the diagnostic process, the basis for the treatment decision, the execution of the treatment, follow‑up, and the information provided to the patient.

    In cases involving infection:
    How did the infection occur? Were there patient‑related factors that increased the risk of infection?

  4. If the treatment was not in accordance with good medical practice, what impact did this have on the further course and the final outcome? Please describe the significance of this.

  5. Provide an assessment of any medical disability and whether the injury is permanent.

  6. Has an incident report or adverse event report been filed in connection with the injury? If so, to whom? Please attach a copy, if available.

Important points to keep in mind

When answering the questions, please note the following:

  • The statement must be based on the information available at the time of treatment and on what constituted good medical practice at that point in time.
  • Avoid hindsight bias. Do not use expressions such as in retrospect or with the benefit of hindsight.
  • Use clear and plain language. The claimant will also read and should be able to understand the statement.

What is a patient injury/treatment injury?

By a patient injury or treatment injury, we mean a physical and/or psychological injury that has occurred as a result of medical treatment, regardless of whether the injury was caused by an error in the treatment.

An injury is considered to have occurred if the treatment resulted in an incorrect outcome or in an unnecessary complication for the patient.

Conditions that are necessary or intended consequences of the treatment are not considered patient or treatment injuries. For example, a normal surgical scar following an operative procedure does not constitute a patient injury.
